Terms of use

These terms govern your use of Klarte.no (“Klarte”, “we”, “the Service”). Before you use the Service, you must read and accept these terms, the platform privacy notice, and the data processing agreement. Acceptance is recorded when you create an account, and when you complete legal onboarding.
1. The Service
Klarte provides online booking software for businesses. You use the Service to offer appointments to your customers (“bookers”).
2. The parties’ roles — controller and processor
You are the controller for personal data you collect from bookers through the Service. You decide why and how the information is used in your business.
Klarte is the processor under Article 28 of the General Data Protection Regulation (GDPR) for booker data. We process that information only on your documented instructions through the Service and the data processing agreement.
Klarte is a separate legal entity, distinct from your business. Bookers contract with you, not with Klarte.
3. Your duties as controller
You alone are responsible for:
- Giving bookers accurate and lawful privacy information
- Having a lawful basis for the processing (including marketing consent where required)
- Responding to access requests and enquiries from supervisory authorities that concern your use of the Service
- Making sure the business details (name, email, address) shown on the booking page and in the privacy notice are correct
- Any extra privacy text you add yourself for bookers
- Complying with applicable law (including the GDPR, marketing rules, and industry requirements)

4. Klarte’s role and limits
Klarte provides technology. We do not do the following:
- Act as controller for booker data
- Decide how you run the business or communicate with bookers
- Guarantee that your use of the Service complies with the law — that is your responsibility
- Take responsibility for how you process the end customer’s data, beyond what expressly follows from these terms and the data processing agreement for our processing as processor
5. Your account
You must provide accurate information and keep your sign-in details secure. You are responsible for activity on your account and for what staff you give access do. If you choose optional Google sign-in, authentication is handled by Google under Google’s terms. Klarte receives only the limited identity details needed to create or recognise your account, as described in the platform privacy notice and the sub-processor list.
6. Subscription, billing, and Stripe
Paid Klarte plans are billed through Stripe (see sub-processors). By subscribing you also accept Stripe’s current payment terms for card processing.
- The subscription renews automatically until it is cancelled in line with your plan.
- Cancellation of the Klarte subscription happens in the billing flow in the Service (Stripe Customer Portal or the equivalent billing settings in the product). Cancellation stops future charges. Access may last through the current paid period, unless something else is stated at payment.
- Refunds of subscription fees to Klarte happen only through Stripe (or via Klarte support, which follows Stripe’s charge and refund basis for your SaaS plan). This is separate from appointment payments from bookers (see section 6a).
- Included SMS and subscription refunds. Some paid plans include a monthly number of SMS reminders (for example Growth includes 150 per month, and Complete 500). When you upgrade or switch to such a plan, the included credits are part of the subscription — not a separate purchase. If a subscription fee to Klarte is refunded (including after an upgrade or plan change), the retail value of included SMS credits already used in that period is deducted from the refund, at the published sale price per SMS credit. You do not get 100% of the subscription amount back if you have used included SMS. Only the remainder after the deduction is refunded. Example: on Growth the refund is reduced by (credits used × sale price per credit) if you have used the included SMS credits. Unused included credits have no cash value and are not refunded separately. Purchased SMS packs (outside the plan quota) follow their own purchase terms and are not returned when a subscription is refunded.
- Billing errors — if a charge failed but you still have paid features, or you were charged incorrectly, contact hjelp@klarte.no promptly so we can correct it via Stripe.
- Unauthorised access — if you become aware that you have access to paid features without a valid subscription (for example because of a billing, payment, or technical error), you must notify us at hjelp@klarte.no within 48 hours. Continued use without a valid subscription after you knew or should have known about the error may be treated as wrongful use. We may close the access, invoice the outstanding amount, or use other remedies the law and these terms allow.
Nothing in this section limits mandatory consumer rights where they apply.
6a. Appointment payment from the booker (Stripe Connect)
If you turn on card payment for bookings, you are the seller and the payee for those charges. The sales contract is between you and the booker. Klarte is a software platform. Klarte is not the seller, not a party to the appointment, and not responsible for performing, cancelling, or refunding the service you offer.
- Who charges the card. Cards are charged on your connected Stripe account (or, in limited test setups, with the platform’s test keys). The published transaction fee on each successful charge from a booker depends on your Klarte plan and is collected through Stripe (including Klarte’s application fee). The fee is not a price shown to the booker on your booking page.
- Cards issued in the EU/EEA. For cards issued in the EU/EEA the published fee is: Start 7.0% + NOK 1.80 per transaction; Basis 4.5% + NOK 1.80; Growth 2.9% + NOK 1.80; Complete 1.95% + NOK 1.80.
- Cards issued outside the EU/EEA. For cards issued outside the EU/EEA, 1.4 percentage points are added to the transaction fee.
- Refunds. You decide whether a booking is refunded (for example from Calendar → Refund). A refund you issue returns the charged amount to the payment method through Stripe. Klarte does not decide disputes between you and the booker, does not guarantee the outcome, and has no duty to pay the booker from Klarte’s own funds. When a charge is refunded in full, Klarte’s application fee on that charge is reversed. Card-network and Stripe costs on refunded charges are usually not returned to you.
- Consumer and industry rules. You alone are responsible for refund practice, cancellation rules, receipts, VAT/invoicing, and rights the booker has against you as the trader. Do not present Klarte as the seller or as the party that received the money.
- Chargebacks and KYC. Stripe’s identity checks, payouts, and card-network disputes happen on your Stripe account. You must complete Stripe onboarding truthfully. Klarte is not your bank and does not hold booker funds as a wallet.
Claims from a booker about an appointment, a payment, or a refund must be directed to you. You shall indemnify Klarte for such claims, except to the extent the claim is caused by Klarte breaching these terms as a software provider.
7. Acceptable use
You may not use the Service for unlawful purposes, spam, or to collect consent in a misleading way (for example by requiring marketing consent in order to complete a booking).
8. Availability — the Service is provided “as is”
The Service is provided “as is” and “as available”. Klarte does not guarantee that the Service is uninterrupted, error-free, or available 100% of the time. Maintenance, updates, faults, and outages at hosting, email, SMS, or payment providers may cause downtime or incorrect behaviour.
Technical measures (HTTPS/TLS, access control, and encrypted backups) are described on the security measures page. The measures are not an uptime guarantee. You are responsible for continuity if the Service is unavailable, including how you handle bookings during downtime.
9. Limitation of liability
To the extent applicable law allows:
- Klarte is not liable for your acts or omissions as controller, including privacy practice, marketing, or replies to bookers
- Klarte is not liable for appointment payments, refunds, payouts via Stripe Connect, chargebacks, or your failure to deliver a booked service
- Indirect loss. Klarte does not cover indirect or consequential loss. That includes lost revenue, lost profit, lost customers, and lost bookings, whether the cause is downtime, a system error, loss of data, or something else
- Liability cap. Klarte’s total liability arising out of the Service is limited to the fees you have paid to Klarte in the twelve (12) months before the event that gives rise to the claim, or one hundred (100) euro if you use a free tier — whichever is higher. That amount is the maximum compensation
Nothing in these terms limits liability that cannot be limited under mandatory law.
10. Indemnity
You shall indemnify Klarte against claims, fees, and costs arising out of your use of the Service as controller — including complaints from bookers, payment or refund disputes, supervisory cases, or third-party claims related to your processing of booker data — except to the extent caused by Klarte breaching the data processing agreement as processor.
11. Termination
Either party may end the agreement in line with the subscription terms. On termination, export and deletion of data follow the data processing agreement and the retention rules.
12. Changes
We may update these terms. Material changes are notified by email or in the product. Continued use after notice counts as acceptance where the law allows it.
